Team Nothing XRP Pulse Charting

Compliance review brief for legal counsel. Entity: Team Nothing Solutions LLC, 4501 Seger Drive, Suite 208, Rapid City, SD 57703, USA.

Questions for the consult

  1. Does publishing concrete entry/stop/target levels, even behind an 'educational, not advice' disclaimer, create investment-adviser or CFTC commodity-trading-adviser exposure for an XRP product?
  2. Is the referral program (free access days for paid referrals) compliant under FTC endorsement rules, given the disclosure banner shown when a visitor lands on a member's referral link?
  3. Do I need to register for sales tax in South Dakota, and what is my EU VAT MOSS exposure for digital subscriptions sold to EU consumers?
  4. Does the educational framing in the Terms and Disclaimers below hold up, or does any specific language weaken the 'not investment advice' position?

The full text of every policy follows below. Bring this document to the call.

Terms of Service

Last updated: October 14, 2026

These Terms of Service govern your access to Team Nothing XRP Pulse Charting (the “Service”), operated by Team Nothing Solutions LLC, 4501 Seger Drive, Suite 208, Rapid City, South Dakota 57703, USA (“we”, “us”). By creating an account, subscribing to a paid plan or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree with them, do not use the Service.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. You are responsible for complying with the laws that apply where you live, and you must not use the Service where doing so would be unlawful.

What the Service is

The Service is an educational market-analytics dashboard covering XRP and the XRP Ledger. It presents price charts, indicators, on-chain metrics, derivatives positioning, news summaries and statistical model output.

It is an information tool only. We are not a broker, exchange, custodian, investment adviser or fiduciary. We do not hold, transmit, manage or take custody of any funds or digital assets on your behalf, and nothing in the Service executes a trade for you.

No financial advice

Nothing in the Service is investment, trading, legal, tax or accounting advice, and nothing in it is a recommendation, solicitation or offer to buy or sell any asset. Signals, scores, predictions, forecasts and automated (“AI”) output are commentary on public data produced by rules and statistical models. They can be wrong, they are not personalised to your circumstances, and past performance is not a guide to future results.

Digital assets are highly volatile and you can lose everything you put in. You alone are responsible for your decisions and their outcome.

Your account

Provide accurate account information and keep your password secure. One account per person: do not share your credentials, and do not resell, sublicense or otherwise give others access to your account. You are responsible for all activity that happens under your account, so tell us promptly through the in-app support chat if you believe it has been compromised.

Subscriptions, billing and renewal

Paid features require an active subscription. The plans and prices in effect when you subscribe are the ones shown on the plans card and on the secure checkout page at that moment, and the amount charged is resolved on our server rather than by your browser.

Payments are processed by Base44 Payments (Wix Payments). Card and billing details are entered on their secure checkout page and go directly to the payment provider; we never see or store your card number.

Subscriptions renew automatically at the interval you selected and continue to renew until you cancel. If a plan includes an introductory or discounted period, it converts automatically to the standard ongoing price shown at checkout when that period ends. We may change prices with notice, and a change applies from your next renewal after the notice.

We email a confirmation of what you bought every time you are charged, and we email you again before a 6-month or 12-month plan renews, stating the amount due, the renewal date and how to cancel.

Cancelling, and refunds

You can cancel at any time, online, with one click from the Plan & billing card on your dashboard: press Cancel auto-renewal and confirm. Cancelling is never harder than subscribing was, and you do not have to contact us to do it, though you may ask us through the support chat instead. Cancelling stops future renewals and your access continues until the end of the period you have already paid for. The Refund & Cancellation Policy sets all of this out in full.

Except where the law requires otherwise, payments are non-refundable and we do not give partial-period refunds. If you believe you were charged in error, contact us and we will put it right.

Free and promotional access

We may give free, discounted or time-limited access, including short trial passes. These end automatically when their stated time runs out, can be withdrawn if misused, and do not create an ongoing entitlement or any expectation of continued free access.

Acceptable use

You agree not to:

  • use the Service unlawfully, or in any way intended to manipulate a market or a price
  • copy, scrape, harvest, resell, sublicense or redistribute the Service, its data or your access to it
  • reverse engineer, decompile, or attempt to bypass authentication, paywalls, gating or rate limits
  • interfere with, overload or disrupt our systems or the third-party data sources the Service relies on
  • misrepresent an affiliation with us, with Ripple Labs, or with any exchange or venue

Third-party data and services

The Service aggregates data from third parties, including exchange APIs, public XRP Ledger nodes, embedded charting widgets, and news and social sources. Those providers' own terms also apply to their data.

We do not control third-party sources and do not warrant their accuracy, completeness or timeliness. Feeds may be delayed, rate-limited, discontinued or blocked, and a card may show stale, partial or failed values as a result. Some third-party sources are experimental or derived from public data, and should be treated as indicative rather than authoritative.

Intellectual property

The Service, including its branding, layout, source code and original content, belongs to us or our licensors. While your access is active we grant you a personal, non-exclusive, non-transferable and revocable licence to use the Service for your own purposes. All rights not expressly granted are reserved.

“XRP” and “Ripple” are the marks of their respective owners. We are an independent product, not affiliated with, sponsored by, or endorsed by Ripple Labs, any exchange or any data provider, and our use of those names is descriptive.

Availability and changes to the Service

The Service is under active development. We may add, modify, suspend or remove features at any time, and we may take the Service offline for maintenance without notice. We do not guarantee any level of uptime, availability or data refresh rate, and we may discontinue the Service entirely.

Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. You use it at your own risk.

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or trading losses, arising out of or relating to your use of the Service or your inability to use it.

Our total aggregate liability to you for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or US $50. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

Indemnity

You agree to indemnify and hold us harmless from any claims, losses, liabilities and reasonable costs arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

Suspension and termination

We may suspend or end your access if you breach these Terms, if a payment fails or is reversed, if we are required to by law, or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability and dispute resolution, will continue to apply.

Governing law and dispute resolution

These Terms are governed by the laws of the State of South Dakota, USA (the state in which Team Nothing Solutions LLC is organized), without regard to conflict-of-law rules.

Before starting formal proceedings, contact us through the app and give us 30 days to resolve the issue informally. If it is not resolved, disputes will be settled by binding individual arbitration in that state, except that either side may bring an individual claim in small-claims court where it qualifies. To the extent permitted by law, you and we each waive any right to a class, collective or representative action. You may opt out of arbitration within 30 days of first accepting these Terms by telling us in writing.

Email and notices

We send transactional messages about your account, subscription and payments, which are part of the Service and cannot be unsubscribed from. Promotional messages are opt-in and every one of them carries an unsubscribe link. Formal notices to you are sent to the email address on your account.

Changes to these Terms

We may update these Terms from time to time. The date at the top will change, and we will announce material changes in the app or by email before they take effect. Continuing to use the Service after a change means you accept the updated Terms.

Privacy Policy

Last updated: October 14, 2026

This policy explains what personal information Team Nothing Solutions LLC (“we”) collects when you use Team Nothing XRP Pulse Charting, why we collect it, and the choices you have. It covers the application and its public pages.

Information you give us

  • Account details: your name and email address, and your password, which is handled by our authentication provider and stored only in hashed form
  • The plan you choose, and the questions, messages and attachments you send through the in-app support chat or the Contact form
  • The content you create in the app, such as custom indicators, strategies, backtests, journal entries, alerts and watch settings

Information created when you use the Service

  • Purchase and entitlement records: which plan, its status, dates and amounts. These never include card numbers
  • Session and presence activity: when you sign in, when your session was last active, and whether a visit is currently open
  • Usage data: which cards and features you open, refresh actions, and error or rate-limit events, together with technical details such as device type, browser, approximate location derived from IP address, and timestamps

Payment information

Payments are processed by Base44 Payments (Wix Payments). Card and billing details are entered on their secure checkout page and are provided directly to them. We receive only the outcome of the transaction, such as the plan, the amount, the status and the email address used, so that we can activate your access. We do not store card numbers ourselves.

How we use it

  • Provide the Service and keep it working, including diagnosing errors, rate limits and outages
  • Activate, renew and record your subscription and entitlements
  • Answer your support requests and contact messages
  • Improve existing features and decide what to build next
  • Send transactional email about your account, subscription and payments
  • Send promotional email, but only where you have opted in
  • Detect and prevent abuse, fraud and unauthorised access, and secure your account
  • Meet legal, tax and accounting obligations, such as retaining sales records

Legal bases for processing (UK and EU)

Where the GDPR or UK GDPR applies, we rely on the following legal bases: performance of our contract with you (providing the Service and billing you), our legitimate interests (keeping the Service secure, preventing abuse and improving the product), your consent (promotional email and any non-essential cookies), and compliance with legal obligations (tax and accounting records).

Cookies and local storage

We use cookies and browser storage to keep you signed in, remember your theme and dashboard preferences, and measure aggregate usage. We do not run third-party advertising trackers and we do not sell your data. You can block or clear cookies in your browser settings, but signing in and keeping a subscription session open require them.

When we share information

We share personal information only with the providers that make the Service work, and only as far as needed:

  • Our payment processor, to take and manage subscription payments
  • Our hosting and backend platform, which runs the application and stores its data
  • Our email delivery provider, to send transactional and opted-in messages
  • AI providers, when you use a feature that generates output, such as price forecasts, research summaries or support replies
  • Analytics and monitoring tools, for aggregate usage and error tracking
  • Professional advisers, and authorities or courts where the law requires it
  • A buyer or successor, if the business or the app is ever sold or transferred

AI features

Some features send content to an AI model to produce a response, for example the one-hour price forecast, event-impact predictions, research summaries and the support assistant. What is sent is limited to what the feature needs, such as recent price data, the market context displayed on screen, or the message you typed. Do not enter sensitive personal information into those prompts.

How long we keep it

Account and profile data while your account is open, and briefly afterwards. Purchase, entitlement and ledger records for as long as tax and accounting rules require. Support conversations for up to 24 months. Presence and session logs on a rolling window. Aggregate statistics, which do not identify you, for as long as they are useful.

Security

Data is encrypted in transit, access to it is restricted by role, and card details are never stored by us. No system is perfectly secure, so we cannot promise absolute security. If a breach affects your information, we will notify you and the relevant authorities as the law requires.

Your rights

Depending on where you live, you may have the right to access your personal information, correct it, delete it, receive a portable copy, object to or restrict certain processing, and withdraw consent at any time where consent was the basis for processing. California residents have the rights to know, delete, correct and to opt out of the sale or sharing of personal information; we do not sell personal information and we do not share it for cross-context behavioural advertising, and you will not be treated differently for exercising your rights.

Exercising a deletion or objection right may mean we can no longer provide paid access. To make a request, contact us through the app and we will verify it against the email on your account. If you are in the UK or EU you may also complain to your local supervisory authority.

International transfers

Our providers may process and store data in the United States and in other countries. Where personal information moves out of your region, we rely on appropriate safeguards such as standard contractual clauses with those providers.

Children

The Service is intended for adults aged 18 and over and is not directed at children. We do not knowingly collect information from anyone under 18. If we learn that a minor has an account, we will close it and delete the associated data.

Changes to this policy

We will update the date at the top when this policy changes, and we will tell you in the app or by email before any material change takes effect.

Contact

For any privacy question or request, contact us through the Contact form or the in-app support chat on the dashboard. Team Nothing Solutions LLC, 4501 Seger Drive, Suite 208, Rapid City, SD 57703, USA.

Refund & Cancellation Policy

Last updated: October 14, 2026

This policy explains, in plain terms, how to cancel a paid subscription to Team Nothing XRP Pulse Charting, what cancelling does, and where you stand on refunds. It forms part of our Terms of Service and it is the policy you accept at checkout.

How to cancel

You can cancel at any time, online, with one click from the Plan & billing card on your dashboard: press Cancel auto-renewal and confirm. There is no call to make and no one to convince.

If you would rather not use the button, ask us to cancel through the in-app support chat or the Contact form and we will do it for you. Cancelling is never harder than subscribing was.

What cancelling does

Cancelling turns off automatic renewal. It stops every future charge and the subscription will not renew when the current billing period ends.

You keep full access to what you paid for until the end of the period you have already paid for. After that date the premium features lock again and your account returns to the free view. You can subscribe again at any time.

Refunds

Payments are non-refundable except where the law requires otherwise. We do not refund or credit a partial billing period, and we do not refund a period that has already run.

This is a digital service delivered immediately, so a statutory right of withdrawal does not apply once your access has started, and you agree at checkout that performance begins straight away. Where the law where you live gives you a refund right that cannot be waived, we honour it.

If a plan starts with an introductory or discounted price, cancelling before that period ends still stops the future renewal, but the discounted period already used is not refunded.

Wrong, duplicate or unexpected charges

If you believe you were charged in error, charged twice, or charged after cancelling, tell us through the support chat with the date and amount. A verified error is refunded in full to the original payment method.

Card and billing details are handled by Base44 Payments on their secure checkout page. We never see or store your card number.

Free, discounted and time-limited access

Free, promotional and time-limited access, including short trial passes, has nothing to refund. These passes end automatically when their stated time runs out and do not turn into a paid subscription.

What you will receive

Every payment is confirmed by email, restating what you bought, the amount, when it renews and how to cancel. Before a 6-month or 12-month plan renews we email you again with the amount due and the renewal date, so you have time to decide before the charge.

Questions

If anything here is unclear, ask us through the in-app support chat or the Contact form before you subscribe and we will answer in plain language.
